What Is a Last Will and Testament?
Vermont states a will “must be signed by the testator and by two or more credible witnesses in the presence of the testator and each other.”
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (14 V.S.A. § 1)
- Sign in the presence of two (2) witnesses. (14 V.S.A. § 5)
Filing
Vermont does not require residents to file their wills during their lifetime. After the testator’s death, the will must be submitted to the probate division of the Superior Court in the district where the testator resided.
