What Is a Last Will and Testament?
Virginia defines a will as “includes any testament, codicil, exercise of a power of appointment by will or by a writing in the nature of a will, or any other testamentary disposition.” (§ 64.2-100)
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 64.2-401)
- The will must be signed by two competent witnesses. (§ 64.2-403)
- The will must be in writing. (§ 64.2-403)
Filing
Virginia does not require residents to file wills prior to death. However, certain probate courts offer safekeeping services for those who choose to file their wills.
