What Is a Last Will and Testament?
Tennessee defines a will as “includes codicil.” (§ 32-1-101)
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 32-1-102)
- The will must be signed by two competent witnesses. (§ 32-1-104)
- The will must be in writing. (§ 32-1-104)
Filing
Tennessee does not require wills to be filed during a person’s lifetime. Probate courts may allow individuals to store their wills for safekeeping for a small fee.
