What Is a Last Will and Testament?
Pennsylvania defines a will as “a written will, codicil or other testamentary writing.” (§ 102)
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 2501)
- The will must be signed by two competent witnesses if not entirely handwritten by the testator. (§ 2502(1))
- The will must be in writing. (§ 2502)
Filing
In Pennsylvania, there is no requirement to file a will while the testator is alive. However, residents may deposit their wills with certain probate courts for secure storage.
