What Is a Last Will and Testament?

Oklahoma defines a will as “includes all codicils as well as wills.” (§ 84-19)

Requirements

To execute a valid will, individuals must:

  • The person creating the will must be at least eighteen (18) years old and mentally capable. (§ 84-41)
  • Two witnesses must sign the will in the presence of the testator. (§ 84-55)
  • The will must be written. (§ 84-55)

Filing

Oklahoma does not require wills to be filed before death. However, probate courts may provide safekeeping services for residents who wish to deposit their wills.
