What Is a Last Will and Testament?
New Hampshire defines a will as ” includes a codicil and must be in writing.” (§ 551:2(I))
Requirements
To execute a valid will, individuals must:
- The testator must be at least 18 years old or married and of sound mind. (§ 551:1)
- The will must be in writing. (§ 551:2)
- The testator must sign the will. (§ 551:2)
- Sign in the presence of two (2) competent witnesses. (§ 551:2)
Filing
New Hampshire does not require individuals to file their wills during their lifetime. After the testator’s death, the will must be submitted to the probate court in the county where the testator resided.
