What Is a Last Will and Testament?

Missouri defines a will as “includes codicil; it also includes a testamentary instrument which merely appoints an executor and a testamentary instrument which merely revokes or revives another will.” (§ 472.010(30))

Requirements

To execute a valid will, individuals must:

  • Be mentally sound and at least eighteen (18) years of age. (§ 474.310)
  • The will must be in writing. (§ 474.320)
  • Sign in the presence of two (2) qualifying witnesses. (§ 474.320)

Filing

Missouri does not require filing a will during the testator’s lifetime. The original will should be submitted to the probate court after death for administration.
