What Is a Last Will and Testament?
Maryland defines a will as “means a record that the testator intends to adopt as the testator’s codicil or testamentary instrument.” (§ 4-101)
Requirements
To execute a valid will, individuals must:
- Two witnesses must sign the will in the presence of the testator. (§ 4-102)
- The will must be in writing. (§ 4-102)
Filing
Maryland does not mandate the filing of wills prior to death. Residents may deposit their wills with the probate court for secure storage if desired.
