What Is a Last Will and Testament?

Louisiana defines a will as “a legal declaration of an individual’s wishes as to the disposition of their property after death.”

Requirements

To execute a valid will, individuals must:

  • Be mentally sound and at least eighteen (18) years of age.
  • The will must be signed by two competent witnesses and notarized. (§ 1577(2))
  • The will must be in writing. (§ 1577(2))

Filing

Louisiana does not mandate the filing of wills prior to death. However, some probate courts provide safekeeping services for those who wish to file their wills in advance.
