What Is a Last Will and Testament?
Kentucky defines a will as a “last will or testament, codicil, appointment by will, writing in the nature of a will in exercise of a power, and any other testamentary disposition.” (§ 394.010)
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 394.020)
- It must be in writing. (§ 394.040)
- Signed in the presence of two (2) credible witnesses. (§ 394.040)
Filing
Kentucky does not require filing a will during the testator’s lifetime. After the testator’s death, the will must be presented to the probate court for administration.
