What Is a Last Will and Testament?
Indiana defines a will as ” includes all wills, testaments, and codicils. The term also includes a testamentary instrument which merely appoints an executor or revokes or revives another will.” (§ 29-1-1-3(38))
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 29-1-5-1(a))
- Sign in the presence of two (2) witnesses. (§ 29-1-5-3)
- The will must be in writing. (Indiana Code (§ 29-1-5-3)
Filing
Indiana does not require residents to file wills during their lifetime. Certain courts may permit individuals to deposit wills for secure storage.
