What Is a Last Will and Testament?
California defines a will as “includes codicil and any testamentary instrument which merely appoints an executor or revokes or revises another will.” (§ 88)
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 6100)
- Sign in the presence of two (2) witnesses who must also sign. (§ 6110(c))
- The will must be in writing. (§ 6110(a))
Filing
The state of California does not require residents to file wills during their lifetime. However, probate courts may offer the option to deposit wills for safekeeping for a fee.
