What Is a Last Will and Testament?
Alabama defines a will as something “that includes codicil and any testamentary instrument which merely appoints an executor or revokes or revises another will.” (§ 43-8-1(34))
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 43-8-130)
- Sign in the presence of two (2) witnesses. (§ 43-8-131)
Filing
The state of Alabama does not require residents to file wills. However, some probate courts do provide residents with the option of depositing their documents for safekeeping for a fee.
